Koi Experience Promotion Terms & Conditions

The Koi Pond promotion is open to selected EU and US residents only until 30th June 2025, at 11.59pm GMT. Entrants must be 18 or over, have a valid EU or US residential and delivery address and will fully state their favorite variety of Koi and why on this post to be eligible. A single entry is available per person, and winners will be chosen at random. Winners will receive an equivalent sum of €6.500 (EU) or $7500 (US) towards Oase products to produce or enhance a Koi Pond. Oase reserves the right to withdraw or amend these terms and conditions without prior notice – please see full terms and conditions here (EU) or here (US) - this promotion is in no way affiliated with Meta Platforms, Inc or its subsidiaries. Please be wary of scam or fake accounts – we will only contact winners from our official social channel. 

1. Promoter  

This promotion is run by Oase GmbH, a German legal entity having its registered address in Tecklenburger Str. 161, 48477 Hörstel, Germany (hereinafter “Oase”), E-Mail: j.saunders@oase.com. This promotion is in no way sponsored, endorsed, administered by, or associated with Facebook. 

2. Eligibility  

The promotion is open to legal residents of the following European countries who are aged 18 or over: 
Belgium, Bulgaria, Denmark, Germany, Estonia, Finland, Norway, France, Greece, Ireland, United Kingdon, Italy, Croatia, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Austria, Poland, Portugal, Romania, Sweden, Slovakia, Slovenia, Spain, Switzerland, Czech Republic, Hungary, Cyprus.

  • Excluded countries: Russia, Ukraine, Belarus, Moldova, Albania, Serbia, Montenegro, Georgia, Armenia, Azerbaijan, Kazakhstan, Bosnia and Herzegovina and North Macedonia, Turkey and Kosovo.
  • Employees of Oase (globally), their immediate families, and anyone else professionally connected with this promotion are not eligible to enter. 
  • Participants who provide false information, violate the rules of the promotion, use automated means to enter, or attempt to manipulate the outcome may be excluded from participation. Oase reserves the right to disqualify entries that are offensive, unlawful, or infringe the rights of third parties.
  • No purchase necessary.

3. How to Enter  

  • To enter, participants must answer the question as a ‘comment’, stating their favourite variety of Koi and why, and confirm they reside in the EU within their entry comment.
  • Only one entry per person is permitted.
  • The promotion begins on Mon 2nd June 2025 at 11am GMT / 7am ET and closes on Monday 30th June 2025, at 11.59pm GMT / 7.59PM ET. Entries submitted after this deadline will not be counted. 

4. Prize  

  • The winner will receive product/s to the total recommended retail price (hereinafter “RRP”) value of €6500 EURO.
  • The prize is non-transferable, non-exchangeable, and no cash alternative is available.
  • One winner from the EU will win up to the value of €6500 EURO RRP worth of Oase products.
  • There is no cash alternative.

The winner must:

1. Respond within 48 hours upon notification.

2. Redeem the prize within 90 days upon notification.

  • If the products chosen by the declared winner are above the RRP 6500 EURO, the winner must pay the difference. Payment must be made in full ahead of order confirmation and delivery timelines being confirmed.

5. Winner Selection & Notification

  • The winner will be chosen at random from all valid entries via “The good luck fairy”, a tool that randomly selects a winner from eligible entries. The decision is final. Legal recourse is excluded. There is no enforceable claim to the prize.
  • The winner will be responded to by the official Oase ‘Show Us Your Koi Pond (Global Community Page by Oase) Facebook page on their entry comment on the pinned promotion post.
  • The winner must respond within 48 hours upon notification to claim their prize. Failure to do so may result in a new winner being selected.
  • The winner must provide Oase with an email address in order to redeem the full prize, and EU delivery (residential) address (no PO Boxes).The EU winner will be contacted by this email address export@oase.com  to facilitate ordering the chosen products and to arrange delivery.

6. Data Protection

  • By entering, participants agree that Oase may use their details solely for the purpose of administering this promotion. The personal data which will be collected is name, Facebook profile, as well as contact information for the selected winner and shall be used for identifying the winner and contacting them. The collected personal data will be deleted after the promotion ends, unless legal obligations apply. Oase does not share the participants’ data with third parties.
  • The legal basis under GDPR is § 6 para. 1 lit. b GDPR - fulfillment of a contract. The participants have right of access, correction, deletion, restriction, objection, and complaint to a data protection authority. Personal data will be handled in accordance with our privacy policy

7. General  

  • Oase reserves the right to amend or withdraw this promotion at any time without prior notice.
  • Oase is not liable for technical problems, delays, or third-party issues.
  • Any incomplete, fraudulent, or automated entries will be disqualified.
  • The decision of Oase is final, and no correspondence will be entered into.
  • This promotion is governed by the laws of Germany. All disputes shall be governed by German law, and the courts of Hörstel shall have jurisdiction.

  • This promotion is in no way affiliated with, endorsed, or sponsored by Facebook or any other social media platform.  

9. Taxes & Legal Responsibilities   

By participating in this promotion (the "Promotion"), you agree to the following terms regarding taxes and legal responsibilities:  

  1. Tax Obligations: Any and all national, regional, local, and other taxes or duties arising from the receipt or use of any prize awarded in this Promotion are the sole responsibility of the winner. The organiser of the Promotion (Oase GmbH) does not assume any responsibility for tax liabilities.
  2. Legal Compliance: It is the responsibility of each participant to ensure that their participation in the Promotion does not violate any local laws, regulations, or restrictions. Oase will not be liable for any consequences resulting from a participant’s failure to comply with applicable legal requirements.
  3. Prize Reporting: If required by law, winners may be required to provide relevant tax or identification information for reporting purposes. Oase reserves the right to withhold or require additional documentation before awarding any prize.
  4. Liability Release: By participating, you release Oase, Facebook, and any associated parties from any claims, liabilities, damages, or losses arising from your participation, receipt, or use of any prize, including but not limited to tax implications.  

By entering the Promotion, you acknowledge that you have read, understood, and agreed to these Terms & Conditions and you confirm that you meet the minimum age requirement of 18 years at the time of entry into this Promotion.  

10. Delivery Fees  

  • Oase will cover the cost of standard delivery for any prize awarded to one of the participating European countries listed under Section 2 above.
  • However, if the recipient is not available to receive the delivery and an additional fee is incurred for redelivery or storage, the winner will be responsible for covering this cost.
